The petitioner alleges illegal and unauthorised construction over the Government land. A proceeding under the West Bengal Highways Act, 1964 has been initiated and it has been reported that hearing in connection with the said proceeding has been fixed on 21st May, 2025.

Learned advocate for the private respondent denies the allegation. It has been submitted that no construction has been made over the public land. 3.

As the issue is already under active consideration of the authority, accordingly, the Court is not inclined to enter into the merits of the submission of the parties.

It will be open for the parties to participate in the subject proceeding. The authority will permit the parties to rely upon all documents and also permit the

parties to file written submission in support of their respective stand.

The authority shall endeavour to dispose of the said proceeding at the earliest.

Report of Officer-in-Charge, Usthi Police Station dated 04.04.2025 is kept with the records. 7.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
