REJECTED C.R.M.(A) 1034 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kotulpur Police Station Case No. 31 of 2024 dated 07.02.2024 under Sections 379/411 of the Indian Penal Code and under Section 21 of Mines and Minerals Development & Regulation Act.

And In Re : Debabrata Pan ...... petitioner Ms. Pampa Dey (Dhabal) ...for the petitioner Mr. Suman De Mr. Debanshu Ghorai .... For the State Petitioner is the owner of the vehicle, which was used for the purpose of transporting sand excavated out of illegal mining. Illegal sand mining in Bengal is a menace both from the environment as also from the economic point of view. Enlarging the petitioner on anticipatory bail will send a wrong signal to the society.

In such circumstances, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected.

The application being CRM (A) 1034 of 2024 is dismissed.
