Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is 20.08 kgs. of ganja allegedly from the possession of the petitioner and he is in custody for 1 year. The investigation has been completed and prosecution has relied upon 10 witnesses in support of its case. Learned DSGI appearing for the NCB opposes the prayer for bail and submits that it is an inter-state racket. Petitioner is a repeat offender.

Refuting such contention, learned advocate for the petitioner submits that the petitioner was earlier acquitted in two cases.

Be that as it may, having regard to the quantum of seizure, period of detention and the fact that 10 witnesses would be examined by the prosecution in support of its case, I am of the view that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Md. Faheem @ Sonu @ Raju Bhai shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, City Sessions Court, Calcutta.

If on bail, the petitioner shall not leave the district of Calcutta for the next three months and shall meet with the investigating officer or any Officer deputed by the Superintendent of Police, NCB once in a fortnight for a period of one year. Accordingly, CRM(NDPS) 609 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
