The petitioner holds the permit being No.PSt.P130/01/02, which has been transferred in his favour vide resolution of the RTA Board dated September 19, 2019.

After transfer of the permit, the petitioner has replaced the previous vehicle attached to the said permit by his own vehicle being WB/37/E-2838. The petitioner's grievance is that in spite of replacement of the vehicle as against the permit, which was earlier transferred in his favour, the said vehicle has not been recorded in the timetable, thereby causing inconvenience and prejudice to the petitioner to ply his vehicle. In this regard, the petitioner has made a representation before the authority dated January 15, 2025. The same is yet to be considered by the said authority. Hence, this writ petition. Mr. Roy, learned advocate appearing for the petitioner seeks expeditious disposal of the representation as above.

Mr. Sen, learned AGP for the State has submitted that in case the vehicle has already been replaced, the same should be inserted in the timetable. Having heard both the parties and after perusal of the documents, this Court finds it proper to dispose of the instant writ petition by directing the respondent no.2/ Regional Transport Authority, Burdwan, Paschim, to consider and decide as regards prayer of the petitioner vide his representation dated January 15, 2025.

In doing so, the said respondent shall allow the petitioner a reasonable opportunity of hearing and pass a reasoned order, if not such prayer of the petitioner is immediately allowed by the same. The entire exercise shall be concluded by the said respondent, within a period of four weeks from the date of communication of copy of this order. With the direction as above, the writ petition is disposed of.

Since no affidavit is called for in this case, the allegations made in the writ petition, are deemed to have been denied by the respondents.

Urgent certified copy of this order, if applied for, shall be supplied to the parties, upon compliance of all necessary formalities.
