Chakraborty ...for the Petitioners Mr. Subhrangsu Panda, Ms. Ina Bhattacharyya ...for KMC 23-09-2024 AKG Ct. 15 It is undisputed that, at the request of the petitioners, the Municipal Building Department by a resolution dated April 13, 2023, recommended the sanction of construction for an additional floor at premises no. 22, Dr. Suresh Chandra Banerjee Road, P.S. Beliaghata, Kolkata - 700 010.

The petitioners seek the implementation of this recommendation.

Mr. Panda, learned advocate, submits on instruction that the relevant Borough-III of the Kolkata Municipal Corporation, upon inspection of the premises, has identified certain unauthorised constructions.

I find no justification for keeping this writ petition pending.

In the facts of this case, I direct the Executive

Engineer of Borough-II, Kolkata Municipal Corporation, to take follow-up steps in accordance with the Municipal Building Department's recommendation dated April 13, 2023, within one month from the date of communication of this order.

Should any unauthorised construction be found to be at the behest of respondent no. 3, the Corporation shall be at liberty to deal with the same in accordance with law.

Accordingly, WPA 8335 of 2024 is disposed of.
