None appears on behalf of the appellant.

The subject-matter of challenge in the present appeal is against an order of acquittal passed by learned Judicial Magistrate, 4th Court, Asansol in connection with Complaint Case No. C/1046/2008 under Section 138 of the Negotiable Instruments Act.

Records reflect that earlier on 20.06.2019, none represented the appellant when the appeal was called. As the appeal is against an order of acquittal and there is reluctance on the part of the de facto complainant to pursue the appeal, I am of the view that no purpose would be served by keeping the appeal pending.

Accordingly, the appeal being CRA 215 of 2019 is dismissed for default.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
