Learned advocate appearing for the petitioner has challenged the order dated 30th January, 2023 passed by the learned Metropolitan Magistrate, 8th Court, Calcutta in connection with CS14199 of 2019. The said order dated 30th January, 2023 is an order under Section 143A of the Negotiable Instruments Act wherein the learned Magistrate was pleased to award 15% of Rs.33,18,338/- which was the cheque amount and directed a sum of Rs.4,97,750/- as interim compensation in favour of the complainant to be paid within 60 days of passing of the order. Certain documents have been referred in the revisional application. Having considered the same, I am of the view that some reconsideration of the quantum of interim compensation is required. Accordingly, instead of the amount of Rs.4,97,750/- the petitioner is directed to deposit a sum of Rs.4,20,000/- with the learned court in favour of the complainant towards interim compensation by 15th December, 2023.

With the aforesaid observations, CRR 1164 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
