Anwar Hossain Ms. Sujata Das .....For the State The present revisional application relates to a prayer for bail in connection with an appeal, I find that the application was preferred under Section 439 of the Code of Criminal Procedure in respect of an order of conviction.

Records reflect that learned advocate who preferred the application relied upon two documents which relate to photostat copy of medical certificate. No document relating to the proceeding pending before the Learned Court has been enclosed. As none appeared on behalf of the State, Ms. Sujata Das, learned advocate who ordinarily represents on behalf of the State is directed to represent the case. Her appointment may be regularized by the concerned authority.

Records also reflect that the revisional application till date has not been adjudicated by any Court. Having regard to the fact that more than 23 years have passed, since the revisional application was preferred, I am of the opinion that by efflux of time the revisional application has become infructuous.

According, C.R.R. 746 of 1999 is dismissed.

Pending application, if any, is consequently disposed of.
