By this writ petition petitioner has challenged the impugned proclamation for sale of the property in question of the petitioner for the recovery of the loan admittedly taken by the petitioner.

Petitioner submits that he wants to avail the benefit of the scheme of One Time Settlement (OTS) policy. Impugned auction notice has lost its force today since time has already expired and till date no fresh auction notice for sale has been issued. Since

petitioner wants to avail the benefit of OTS, petitioner shall make application under the aforesaid policy within the framework of that policy within seven days from date and the same shall be considered by the respondent authority concerned in accordance with law and within the framework of the aforesaid policy and take a decision on the same and shall intimate the same to the petitioner within a week from date of taking such decision.

In case petitioner fails to file such application within the time stipulated herein, the respondent bank will be free to proceed in accordance with law for realization of its loan in question.

With this observation and direction this writ petition being WPA 7743 of 2023 is disposed of. (Md. Nizamuddin, J.)
