Mr. Debasish Sur Mr. Angshuman Patra Mr. Joy Bhattacharyya Mr. Mrinmoy Chatterjee ... for the petitioner Ms. Paramita Pal ..for the State The petitioner has alleged inaction on the part of the Officer-in-Charge, Nischinda Police Station, under Howrah Police Commissionerate. According to the petitioner, although his wife has been missing for a long time, the police authorities have failed and neglected to recover the missing person.

A complaint lodged by the petitioner was registered vide GDE no. 367 dated October 7, 2020. On enquiry, it was revealed that the wife of the petitioner left her matrimonial home on her own will and volition, especially to avoid the physical and mental torture that was inflicted upon her by the petitioner. She has written a letter to the Howrah Police Commissionerate with a request that she should not be forced to go to her husband's house and no one should look for her. She stated that she was living separately and she was at peace. Her living conditions were good. The said letter is produced before this Court.

Under such circumstances, I do not find that the police authorities have failed to discharge their duties under the law.

The police report is taken on record.

This writ petition is disposed of without any orders.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
