At the very outset, learned Advocate for the writ petitioner draws attention of this Court at page 26 of the writ petition being a photocopy of the LR Record in respect of the suit property which stands in the name of the writ petitioner.

It is further submitted on behalf of the writ petitioner that though the writ petitioner is a recorded owner of the suit property, but the private respondent no. 6 with the aid and assistance of the local hooligans and undesirable persons are making an attempt to grab the property of the writ petitioner for which the writ petitioner had lodged a written complaint dated 09.02.2024 with the respondent no.5, but unfortunately no action has been taken by the respondent no.

The Officer-in-Charge, Kashipur Police Station, Post OfficerUttar Kashipur, District-South 24-Parganas.

It is, thus, submitted that an appropriate order may be passed directing the respondent no. 5 to take appropriate action on the basis of the written complaint dated 09.02.2024.

After hearing the learned Advocate for the writ,

petitioner and the learned Advocate of the State as well as upon consideration of the entire materials on record, it appears to this Court that justice would be subserved, if the respondent no. 5 i.e., The Officer-in-Charge, Kashipur Police Station is directed to take appropriate action on the basis of the written complaint as lodged on behalf of the writ petitioner on 09.02.2024 and thereafter shall proceed with the same in accordance with law. 6.

Ordered accordingly.

With the above observations, the instant writ petition being WPA 8373 of 2024 is hereby disposed of.

Liberty is given to the writ petitioner to communicate the server copy of this order to the respondent no. 5.

Respondent no. 5 is hereby directed to act on the server copy of this order.
