In Re : An application under Section 482, 397 and 401 of the Code of Criminal Procedure, 197, read with Article 227 of the Constitution of India;

In the matter of : Pradip Ranjan Paul. ...petitioner. The present revisional application was preferred challenging the proceedings relating to Case No.1224 of 2010 under Section 498A/406 of the Indian Penal Code pending before the learned Judicial Magistrate, 2nd Court, Barasat, District-North 24 Parganas.

The order dated 27.04.2012 passed by a co-ordinate Bench reflects that there was an interim order for a period of two weeks after Summer Vacation of the said year. The interim order thereafter was never extended.

Having regard to the fact that this Court has not been made aware of the present stage of the proceedings before the learned Magistrate, it would not be fit and proper to interfere with the proceedings at this belated stage almost after nine years. However, the petitioner would be at liberty to agitate the points canvassed in the revisional application at the final stage of arguments of the case, if the same is pending before the learned Magistrate.

With the aforesaid observation, CRR 1091 of 2012 is disposed of.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
