Learned counsel for the respondent/Kolkata Municipal Corporation submits that the land of the playground belongs to private person.

The record reflects that in spite of repeated opportunity to the petitioner permitting him to submit the document in support of plea that the land in question used for playground is not owned by the private person but is a public land, no such document has been placed on record.

Be that as it may, since no one is present for the petitioner to prosecute this petition, therefore, the petition is dismissed in default.
