The commercial quantity of contraband, namely, 40 bottles of phensedyl were recovered from the exclusive possession of the petitioner. In view of the embargo created under Section 37 of the NDPS Act it is not the fit case where the petitioner should be enlarged on bail. However, our attention is drawn to the fact that there is no substantial progress in the trial.
The Learned Advocate for the State draws our attention to the fact that out of eight charge-sheeted witnesses, seven has already been examined and only one is left. In view of the above, we request the Learned Special Judge, NDPS Court to complete the recording of the evidence of the left out witness within a month from date and thereafter will bring the case to its logical end within three months therefrom. In course of hearing without saying that the Counsel for the prosecution and the witness will cooperate and assist the Learned Special Judge in adhering the time
limits indicated hereinabove and shall not indulge in asking adjournments except on an unavoidable circumstances. The prayer for bail is rejected.
