No. 29 KAUSHIK REJECTED C.R.M.(A) 1357 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Chanchal Police Station Case No. 774 of 2021 dated 11.09.2021 under Sections 363/365 of the Indian Penal Code, 1860 and added Section 4 of the POCSO Act.

And In Re : Choton Khan ...... petitioner Mr. Rana Mukherjee Mr. Riddhiman Mukherjee ....for the petitioner Mr. Sudip Kumar ....for the State The police case is dated September 11, 2021.

The victim is a minor, who recorded her statement under Section 164 of the Code of Criminal Procedure implicating the petitioner.

In such circumstances, in view of the long absconsion of the petitioner in respect of the present police case and the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1357 of 2023 is dismissed.
