Learned advocate appearing for the petitioner submits that the subject matter in the present case relates to alleged recovery of 248 bottles of phensedyl and the petitioner is in custody for 4 months. Charge-sheet has already been submitted and charges have already been framed. However, witness action is about to commence.
Learned advocate for the State opposes the prayer for bail and submits that the petitioner fled away from the spot and date has already been fixed for cross-examination of the prosecution witnesses.
Having considered the quantum of seizure, period of detention and the time which will be consumed for taking the trial
to its logical conclusion, I am of the view that further detention of the petitioner is unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Rafikul Sardar @ Rafikul shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned ADJ, 3rd Court, Dakshin Dinajpur at Balurghat. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Dakshin Dinajpur without prior permission of the learned special court. Accordingly, CRM(NDPS) 610 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
