Petitioner made application for transfer on the ground of distance in between present school of the petitioner and his place of residence on 25th August, 2022 on Utshasree portal.

It is submitted on behalf of the petitioner that Sub-Inspector of Schools of the concerned circle forwarded the transfer application of the petitioner through portal to District Primary School Council, Bankura for taking decision but till date no decision has been taken by District Primary School Council, Bankura.

State respondents and District Primary School Council, Bankura are represented by learned advocates.

It is submitted on behalf of the District Primary School Council, Bankura that if direction is given upon the appropriate authority, transfer application of the petitioner shall be decided in accordance with law.

In view of submissions made on behalf of the parties, the writ petition stands disposed of by directing the Chairman, District Primary School Council, Bankura being respondent no. 6 to take decision on transfer application of the petitioner by six weeks from date of communication of this order in accordance with law and the decision to be taken by respondent no. 6 shall be communicated to the petitioner by ten days thereafter.

However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
