From the report it transpires that the opposite part i.e. Aurobinda Bhattacherjee has expired on 19.03.2007 on the basis of a report filed by the SI of Kalighat police station along with a copy of death certificate to that effect.

The appeal abates and disposed of accordingly. Lower court records along with a copy of this order be sent down at once to the learned trial court for necessary action. (Ananya Bandyopadhyay, J.)
