31.03.2023 sdas rejected C.R.M. (DB) No. 1264 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Udaynarayanpur Police Station Case No. 24 of 2016 dated 02.03.2016 under Sections 302/34 of the Indian Penal Code.

And In Re : Bappa Pandit ..... petitioner Mr. Rafikul Islam Sardar ... for the petitioner Mr. Prasun Kumar Datta, learned APP Mr. Pradipta Ganguli ... for the State Learned Counsel for the petitioner submits he renews his prayer for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. There are materials implicating the petitioner in the murder. Due to allegation of threatening witnesses case was transferred. Under such circumstances, we do not find it prudent to enlarge the petitioner on bail.

The application for bail is, thus, rejected.
