The appellant is not represented, nor any accommodation is prayed for on behalf of the appellant.

Inspite of having adequate notice and a peremptory order being passed for removal of defects, no attempt has been made by the appellant.

In view of the report of the Assistant Registrar dated 09.02.2023 it appears that the defects have not been removed in terms of the order dated 01.10.2021 and no application for substitution has been filed in terms of the orders dated 28.01.2020 and 03.3.2020, the appeal stands dismissed for non-removal of the defects and non filing of the application for substitution upon the death of respondent no. 2.

Interim order, if any, stands vacated.

L.C.R, if arrived, be sent down to the appropriate court.
