The petitioner is aggrieved that the private respondent has not been named as accused in the charge sheet being New Barrackpore PS Charge Sheet No. 460/21 dated 19.10.2021.

Police have reserved their rights to file supplementary charge sheet.

The petitioner has moved before the Magistrate under Section 173(8) of the Cr. P.C. and the Magistrate is therefore directed to dispose of the petitioner's application as expeditiously as possible preferably within a period of 2 months from date.

The petitioner claims that he has lodged further complaint as regards the treat and intimidation by the private respondents.

Counsel for the private respondents submits that the writ petition is a result of political rivalry between the members of the same political party.

The petitioner may approach a competent forum, inter alia, under Section 156(3) of the Cr. P.C. in this regard.

With the aforesaid observation, the instant writ petition shall stand disposed of.

7.

There shall be no order as to costs.

8.

The report of the New Barrackpore Police Station dated 10.04.2023, is kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
