G.S.Das Mr. Sourav Mondal Mr. Rony Mondal ... for the Petitioner(s) Mr. Joydip Banerjee Mr. Prabir Kumar Ray ... for the State-respondent(s) The petitioner is aggrieved by the fact that the private respondents have illegally usurped her property by taking the assistance from the local political influential persons. In fact, when the petitioner intended to visit her land, the private respondents threatened her of dire consequences including causing severe injuries by way of using deadly weapons and explosives. But, in spite of informing the police authorities, till date, the police authorities did not take any step, as such, the petitioner is unable to have any access to her own property.

State has submitted a report

which reflects that some of the private respondents are in possession of the property, who resides over there and others are residing in a separate district who are aged persons.

The genesis of the dispute, as is reflected from the report, is in respect of inheritance of the ancestral property.

So far as the issue relating to right, title, interest and possession of the property is concerned, the learned civil court is the appropriate forum to canvass the issues. If there are any disputes and/or differences, the civil court will adjudicate the same.

Accordingly, it is directed that if any directions are passed upon the police authorities by the learned civil court, the police authorities would respect, obey and implement such order.

In the meantime, the police authorities would ensure that no breach of

the peace and/or tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 7715 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
