Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a student pursuing a B.Tech Course. The victim girl was aged about 21 years. She committed suicide by hanging at her parental home. It is alleged that although after finding out the relationship between the petitioner and the victim, the families arranged a marriage for them, finally, the petitioner's family decided to arrange their son's marriage elsewhere. As a result, the victim was depressed and committed suicide. The present petitioner is not at all responsible for such unfortunate incident. Learned Sessions Court allowed the prayer for anticipatory bail of the parents of the petitioner. Learned counsel appearing on behalf of the State relies on the case diary, opposes the prayer for anticipatory bail and submits that
the petitioner and his parents had instigated the commission of suicide. Investigation is going on.
This is a very unfortunate case of suicide, which possibly might have been avoided by further talks and negotiations. However, considering the materials available in the case diary and in view of the fact that the death took place in the parental home of the petitioner, I do not think that this is a fit case for custodial interrogation of the petitioner.
Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer subject to the conditions that he shall meet the Investigating Officer once a fortnight till submission of report in final form, cooperate with the investigation and shall not threaten or intimidate witnesses or tamper with evidence in any manner whatsoever. The application for anticipatory bail being CRM(A) 1130 of 2025 is, thus, allowed.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
