The petitioner is aggrieved by the fact that no proper investigation was carried out in connection with Raghunathpur P.S. Case No. 196/2018 dated 24.11.2018 and the police authorities submitted charge-sheet in the year 2022 under Sections 302/120B of the Indian Penal Code without collecting proper materials. The petitioner preferred an application under Section 173(8) of the Code of Criminal Procedure before the jurisdictional court for further investigation and further investigation was allowed by the concerned court. However, the petitioner is unaware regarding progress of the further investigation.

Learned advocate appearing for the State submits that after further investigation, a

supplementary charge-sheet has been submitted before the jurisdictional court on 31.01.2025 and in the said supplementary charge-sheet two persons have been implicated as accused and asked to face the trial in a court of law.

Further report is awaited so far as Cyber Forensics & Digital Evidence, Examiners'

Laboratory, CID, West Bengal is concerned. The investigating officer has pointed out that the said report would be submitted in due course before the jurisdictional court.

Having considered the steps taken by the investigating agency, I am of the view that proper course of action has been taken by the police authorities while further investigating the case. Steps be taken before the jurisdictional court for expediting further progress of the case.

Since the police authorities have been sincere enough to carry forward the investigation, further pendency of the writ petition before this Court is unwarranted.

Accordingly, the writ petition being WPA 7785 of 2023 is disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
