The petitioners have challenged a proceeding under Section 7A of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952. The petitioners have been enjoying an interim order dated 23rd May, 2008.

The respondent is represented and prays for dismissal of the writ petition on the ground of an alternative remedy and that the petitioners are deliberately avoiding this Court.

The matter was adjourned on 25th January, 2021 and 27th January, 2021 when none had appeared on behalf of the petitioners.

The respondent relies on notices issued to the petitioners and the Advocates who had been appearing on behalf of the petitioners.

I am of the view that absence of the petitioners is deliberate and intentional.

In view of the aforesaid, WPA 5467 of 2008 is dismissed for default.

Interim orders, if any, stands vacated.
