Mr. Kishore Mukherjee, Mr. Sankha Subhra Ray ... For the petitioners. The order proposed to be passed in the present revisional application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present revisional application upon the said opposite parties is dispensed with.

The petitioners filed a suit for rectification of a deed of sale. The said suit was dismissed and aggrieved thereby the petitioners have preferred the Title Appeal No. 02 of 2020, which is now pending before the 1st Court of learned Additional District Judge, Kakdwip, District - 24 Parganas (South).

The petitioners are praying a direction upon the appeal Court below for expeditious disposal of the said appeal.

Mr. Mukherjee, learned advocate appearing on behalf of the petitioners submits that the petitioner no. 1, one of the appellants of the said appeal is an

octogenarian, as such the appeal is required to be heard expeditiously.

Considering such submission of Mr. Mukherjee, the learned Additional District Judge, 1st Court at Kakdwip is requested to expedite the disposal of the said appeal and in doing so shall not grant any unnecessary adjournment to either of the parties. C.O. 860 of 2021 is thus disposed of without any order as to costs.
