IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction 07-03-2022 Subha Item-100 Ct -.34 C.R.R 1062 of 2018 In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.

In the matter of : Sri Laxmi Naryan Yadab.

...Petitioner.

Mr. Bibaswan Bhattacharya ......for the Petitioner.

Mr. Uday Sankar Chattopadhaya Mr. S. Maji Mr. S. Sahah ......for the opposite party.

Mr. Bhattacharyya, learned advocate appearing on behalf of the petitioner submits that so far as the quantum of maintenance which was awarded, the petitioner is not challenging the same, however the direction for paying the arrear maintenance is creating the hardship for complying with the order. Mr. Chattopadhyay, learned advocate appears on behalf of the private opposite party/wife.

After considering the submissions advanced by the petitioner as well as the private opposite party, I am of the view that the petitioner would pay a sum of Rs.10,000/- in addition to regular maintenance being paid and such amount would be continued to be paid by the petitioner till the present dues are

exhausted.

With the aforesaid observations, CRR 1062 of 2018 is disposed of.

All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is, hereby vacated.

All concerned parties are to act in terms of a website copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. ) .
