Mr. Suman Patra .....for the Petitioner(in person) The petitioner submits that the present case was initiated in the year 2017, more than 5 and 1⁄2 years have passed since registration of the case and the investigating authorities submitted charge sheet against nine accused persons in connection with G.R. case no.65 of 2017 under Sections 498A/406/354B/386/325 of the Indian Penal Code.

A report was called from the Officer-in-Charge, Uttarpara Police Station, the report reflects that the next date is fixed on June 23, 2022 for evidence of prosecution. In view of the fact that the petitioner and others are appearing in Court for 5 and 1⁄2 years, the learned Court in seisin of the matter is directed to fix at least one date in a month so, that the trial of the case can be taken to its logical conclusion within a reasonable period of time. It has been brought to the notice of the Court that the parents of the petitioner who has also been implicated as an accused are suffering from medical ailments.

Learned Magistrate is directed, in case an application under Section 205 of the Code of Criminal Procedure is preferred on behalf of such senior citizens with medical documents. The

Learned Court on an undertaking given by the such accused persons would allow them to be present through their lawyer until and unless their physical presence is absolutely necessary and would deter the Trial Court to proceed with the trial. No unnecessary adjournments should be granted to either of the parities and the Public Prosecutor conducting the case should take steps, so that the witnesses do appear on the date so fixed.

With the aforesaid observations, CRR 953 of 2021 is disposed of.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
