Petitioner is aggrieved that her representation dated 24.02.2025 was not considered by the Officer-in-charge, Dhaniakhali Police Station. Petitioner complains that the private respondent and his associates forcefully demolished the pillar in the land of the petitioner and when resisted they abused and threatened the petitioner of dire consequences. Learned advocate for the State has submitted a report. Report reflects that police authorities enquired and found that unjustly the petitioner was chased when she went to her land by the private respondent no. 5 and his associates and

as such a prosecution was drawn under section 126/135(3) of the BNSS.

Learned advocate appearing for the respondent no. 5 submits that Title Suit no. 114 of 2024 has been filed before the learned Civil Judge (Junior Division), Chinsurah, Hooghly. An ad interim order of injunction has also been passed.

Considering the fact that a land dispute is palpable on the face of it, I am of the view that the petitioner would seek relief from the civil court as it has been submitted that the husband of the petitioner is already a party in the civil suit. In case any order is passed upon the police authorities, police authorities under those circumstances would respect, obey and implement the order. In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the strained relationship existing between the parties.

With the aforesaid observations WPA 7776 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.
