Salauddin Tarafdar @ Md Salauddin Tarafder v. State Of West Bengal
08.04.2025 Sl. No.16 Ct. 28 Reject NB C.R.M. (A) 1131 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Amdanga P.S. Case No.57 of 2025 dated 17.01.2025 under Sections 25/27/35 of the Arms Act and Section 4/6 E.S. Act pending before the learned Additional Chief Judicial Magistrate, Barasat, North 24-Parganas.
In the matter of : Salauddin Tarafdar @ Md. Salauddin Tarafder ... petitioner Mr. Surajit Basu, Ms. Jasika Alam.
...for the petitioner.
Mr. Saibal Bapuli, Mr. Arani Bhattacharyya.
...for the State.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was not aware that some accused had kept bombs in the petitioner's property. There is no incriminating material available against the present petitioner. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that the seizure of the bombs were made from the backyard of the petitioner's house. The co-accused had admitted that there was a conspiracy between them and the petitioner in this regard and there are statements of independent witnesses that the seizure was made from the petitioner's property. Three accused have been arrested.
In view of the materials available in the case diary and the fact that the case is at the stage of investigation, I am not inclined to grant anticipatory bail to the petitioner.
The application for anticipatory bail being CRM(A) 1131 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
