Rakib (Allowed) CRM (M) 865 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chandipur Police Station case no. 387 of 2025 dated 15.10.2025 under Sections 80/85/103(1) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3/4 of the Dowry Prohibition Act, 1961. And In the matter of : Sahajadi Bibi @ Shahajadi Bibi & Ors. ......Petitioners.

Learned advocate appearing for the petitioners submit that petitioners are all sister-in-laws of the victim and petitioners nos. 1 and 2 are married sister-in-law whereas petitioner no. 3 is unmarried sister-in-law. All the petitioners are in custody for 130 days. It has been submitted by the petitioners that they are innocent of the charges and out of matrimonial discord the victim consumed poison for which the petitioners have been foisted with the criminal case.

Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of witnesses including the post-mortem report.

I have taken into account the period of detention of the present petitioners and the fact that charge-sheet has been

submitted and the prosecution has relied upon 22 witnesses. Having considered the period of detention and the fact that the trial will take some time as also no case has been made out that these petitioners administered poison to the deceased, I am inclined to release the petitioners on bail at this stage. Accordingly, the prayer for bail of the petitioners is allowed.

As such, the petitioners, namely, Sahajadi Bibi @ Shahajadi Bibi, Rosnara Bibi and Husnewara Bibi @ Hosnara Khatun @ Osnara Khatun shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Tamluk, Purba Medinipur.

If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Purba Medinipur without prior permission of the learned Trial Court.

Accordingly, CRM (M) No. 865 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
