Learned advocate appearing for the petitioner submits that the de facto complainant is anxious regarding the manner in which the proceedings are progressing. It has been pointed out that the case has been committed to the court of sessions and presently pending before the learned Additional Sessions Judge, 3rd Fast Track Court, Berhampore, Murshidabad.

According to the learned advocate for the petitioner charges are yet to be framed and the next date has been fixed on 04.06.2024.

Having considered that the case was instituted in the year 2020 and the next date has been fixed on 04.06.2024, I am of the opinion that four years have passed since the initiation of the case. Having regard to the time period which has passed, I direct the learned trial court to overcome the stage of consideration of charges on the next date so fixed or within a fortnight thereafter. The learned trial court after consideration of charges, if it is of the opinion that trial of the case is required to be conducted, in that case the learned trial court would fix at least a schedule consisting of three dates and fix such schedule once in every sixty days so that trial of

the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties.

All efforts be taken by the stakeholders to cooperate with the learned trial court in the progress of the trial of the case, if any.

With the aforesaid observations, the revisional application being CRR 1235 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
