Petitioner(s) Mr. Biplab Majumder ... for the Petitioner(s) Mr. Sanjay Banerjee Mr. Asif Dewan ... for the State-respondent(s) The subject-matter of the case relates to alleged recovery of 31.4 kg of ganja and the said seizure was made from a house which do not belong to the petitioner. However, the petitioner was allegedly shown by the police authorities when he was present at the house. It has also been contended that the petitioner is in custody for 11 months and there has been no progress in the trial of the case.

Learned advocate for the State, on the other hand, submits that the trial could not proceed because one of the accused persons is absconding.

The records of the case speak that the petitioner earlier approached when the case was at the same stage.

Accordingly, I direct that the learned trial court would split up the trial of the case; overcome the stage of consideration of charges and within 30 days from the date of consideration of charges, date be fixed for evidence of the seizure list witnesses.

Having considered the stage of the case, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

The petitioner would renew his prayer for bail after the evidence of the seizure list witnesses is over. Accordingly, CRM (NDPS) 620 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
