The petitioner has challenged an order of transfer dated March 6, 2023, in the present writ petition. The petitioner is working in a clerical position with the Indian Overseas Bank. The petitioner joined his service sometime in September 2014. The petitioner was transferred to Kadamtala Branch from Howrah Branch (Small Medium Enterprise) on December 1, 2018. On December 7, 2018 the petitioner was transferred back to Small Medium Enterprise, Howrah Branch.

By a transfer order dated March 6, 2023 the petitioner was transferred on administrative grounds to Sialdanga Branch. The petitioner submits that the said Branch is situated more than 50 k.m. from the earlier place of posting and the same is contrary to the own transfer policy of the Respondent-Bank.

Mr. Debnath, learned counsel appearing on behalf of the respondent-Bank submits that the petitioner has been posted within 40 k.m. from his place of residence and as such there is no violation of transfer policy. Considering the submissions of the parties and the materials placed on records, this court directs the representation of the petitioner dated March 8, 2023 be considered by the Chief Manager (HR)/the respondent No. 3 or any other authority dedicated by him within 8 weeks from date.

Let a reasoned order be passed and communicated to the petitioner within two weeks of passing thereof.

With the directions aforesaid, WPA 7807 of 2023 is disposed of.

Since no affidavits have been invited in the writ petition, the allegations in the writ petition be deemed not to have been admitted by the parties. All parties to act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
