28.02.2022 gd/ssd WPA/7356/2006 BAROWARITALA PURBA PARA NAGARIK UNNAYAN SAMITY VS THE STATE OF WEST BENGAL & ORS.

(Through Video Conference) Mr. Tapan Kumar Mukherjee, Mr. Pranab Halder, Mr. Somnath Naskar ..for the State.

Mr. Satyajit Talukdar ..for the Respondent Nos.3, 4 and 5.

Counsel for the petitioner is not appearing in the matter and the writ petition itself is pending since 2006. In pursuance to the previous direction of this court status report in the form of affidavit has been filed by the State.

On perusal of the record it is found that the petitioner had approached this court by way of present public interest litigation seeking a direction to the respondents to complete the construction of the vehicular bridge on Kestopur Canal by the side of AJAK Block of Salt Lake City connected with Krishnapur Samarpally-Siddhartha Nagar of Mouza Krishnapur. The above prayer was made keeping in view the earlier orders of this court dated 22.03.2002 passed in WP 3588(W) of 2002 and the order dated 16.02.2005 in WP

16304(W) of 2004.

In compliance report filed by the State today it has been stated that:

"3. That a Reinforced Concrete Bridge is being constructed by Irrigation & Waterways Directorate at the same location ie. in between AJ & AK Block of Salt Lake City connected with Kestopur Bidhannagar over Kestopur Canal.

4. That the present status of the work - the bridge portion has already been completed and now the approach roads of the Bridge are being constructed which will be completed within very few months. Copy of the report dated 22.02.2022 and order of the Hon'ble Court are annexed herewith and marked as Annexure A collectively." The above compliance report reveals that the bridge, as prayed for by the petitioner, has already been constructed and the work of approach road is going on. Hence, we dispose of the present petition directing the competent authority to complete the work of the approach road expeditiously.
