In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

This revisional application was preferred challenging the Complaint Case No. CS 8073 of 2021 pending before learned Metropolitan Magistrate, 7th Court, Calcutta. The petitioners were implicated as accused in the case. The subject-matter involved is Rs.9,22,801/-. The petitioners have relied upon the statement of accounts and relevant documents which they are of the opinion would reflect that no case has been made out.

Having regard to the nature of the document which has been relied upon, I am of the opinion that the same cannot be appreciated at this stage. Records also reflect that when the matter appeared on 28.04.2021, none represented the petitioners. today also when the matter has been called, none represented the petitioners. Having regard to the issue which has been canvassed in the present revisional application, I am of the opinion that this Court is not in a position to decide on photostat copies of the documents without certified copies of the same being placed before this Court.

The petitioners would be at liberty to produce the relevant documents before the learned Magistrate at the

appropriate stage of the trial in order to rebut the prosecution case.

With the aforesaid observations, the revisional application being CRR 957 of 2021 is disposed of. All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
