(NDPS) 417 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with NDPS case no. 31 of 2024 arising out of Kalischak Police Station case no. 667 of 2024 dated 15.5.2024 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

Das Mr. Sumit Routh ...for the Petitioner Mr. Anand Keshari Ms. Poulami Bose ...for the State This is an application for renewal of the bail prayer. The bail prayer of the petitioner was rejected by this court on 16th January, 2025.

Petitioner submits that the police has falsely implicated him showing vicarious liability which is unknown to the criminal jurisprudence and that he is in custody for about one year and charge has not yet been framed and it will take long time to conclude the trial and as such, he prayer for bail on any terms and conditions. .

Learned counsel for the State vehemently opposes the prayer for bail contending that there are sufficient materials in the case diary in support of the money trailing and that the present petitioner has sent money continuously to other coaccused, Bablu and that the neighbours have made

incriminating statements against the present petitioner and that if he is released on bail, there is every chance of his absconsion and also committing similar type of offence in future.

Having considered the facts and circumstances of the case and the materials available in the case diary, I find that the condition imposed under Section 37 of the NDPS Act attracts in the present case in respect of the present petitioner and as such, the prayer for bail is considered and rejected. However, the Trial court is requested to expedite the trial and will make every endeavour to conclude the entire proceeding as early as possible, preferably within a period of one year from the next date of hearing.

Accordingly, CRM (NDPS) 417 of 2025 are disposed of. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
