The present revisional application was preferred challenging the proceedings of Special Case No. 5 of 2008 under Sections 409/420/465/467/468/471/120B of the Indian Penal Code arising out of Dhaniakhali Police Station Case No. 81 dated 09.12.2008.
This revisional application appeared on 28.04.2021 when none represented the petitioner. In view of the subjectmatter of this revisional application, Mr. Arijit Ganguly, learned advocate, who ordinarily appears for the State, is directed to represent the State. His appearance may be regularised by the concerned authorities.
As the initiation of this case was in the year 2008 and more than 15 years have passed since the initiation of this case and the case was directed for inspection of the records, I am of the opinion that at this belated stage without any evidence being recorded, it would not be fit and proper to interfere with the proceedings wherein the investigating authority on conclusion of investigation has collected materials for framing of charges.
Accordingly, the revisional application being CRR 959 of 2021 is dismissed.
All pending connected applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
