This revisional application has been filed praying for expeditious disposal of Title Suit No.1549 of 2018, pending before the learned Civil Judge (Junior Division), 1st Court at Alipore, District 24 Parganas (South).

It is submitted that the plaintiff was absent on one day and the learned court below fixed May 3, 2019 for filing of a show cause by plaintiff, as to why the suit shall not be dismissed for default. It is submitted that thereafter the plaintiff filed the show cause but the same has not yet been accepted by the learned court below and the learned court below has fixed several dates.

Under such circumstances, this revisional application is disposed of with a direction upon the learned court below to dispose of the pending application/show cause filed by the plaintiff/petitioner expeditiously and in accordance with law, preferably within a period of one month from the next date fixed.

This Court has not gone into the merits of the claims and counter-claims of the parties and the learned court

below will proceed in accordance with law and on the merits of the case.

The petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the opposite parties and/or their learned advocate appearing in the learned court below within a week from date.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
