By filing this writ petition, the petitioner has challenged a suspension order dated January 28, 2023.

By the said order, the Governing Body of Charuchandra College suspended the petitioner till the completion of the enquiry by the Internal Complaints Committee of the said College.

It has been submitted by Mr. Kallol Basu, learned advocate appearing for the college that since the college did not find any suitable person to be appointed as the Presiding Officer, the committee could not be reconstituted.

This Court has already disposed of CAN 1 of 2023 in WPA 2709 of 2023, by directing the college to appoint Dr. Debolina Sen, an Associate Professor of the College as the Presiding Officer of the committee.

Therefore, this writ petition is disposed of with a direction upon the college to ensure that the Internal Complaints Committee completes its enquiry against the petitioner under the University Grants Commission Regulations 2015 within a period of three months from date of reconstitution of the Committee.

However, I make it clear that if the Internal Complaints Committee cannot complete the enquiry within the said period of three months without any justifiable reason, the suspension order issued against the petitioner shall stand revoked.

Accordingly, WPA 7808 of 2023 is disposed of. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
