The grievance of the petitioner is that, despite having applied as per due process of law, no new electric connection has been given to the petitioner.

Learned counsel appearing for the WBSEDCL contends that the necessary requisites for installation of such meter were not found in the premises at which the connection was sought to be taken.

As such, despite their best efforts, the distribution company had no option to give such connection. Learned counsel for the petitioner, in his usual fairness, submits that the petitioner shall comply with all the formalities as required by law and as indicated by the distribution company within a period of two weeks from date.

Accordingly, WPA 8752 of 2021 is disposed of by directing the petitioner to comply with all formalities required to give a new electric connection within a period of two weeks from date.

Upon such compliance, the petitioner will be at liberty to approach the distribution company with prima facie proof of such compliance and file a fresh application for new connection.

Upon due compliance of all requisite formalities, the distribution company shall consider such application afresh, without being prejudiced by any of the observations made herein, and shall grant such new connection in the event all formalities are completed on the part of the petitioner, preferably within four weeks after such application.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
