Dipankar Roy v. State Of West Bengal And ANR
07/04/2026 D/L - 40 Court No.28 S. Kundu Rejected C.R.M.(A) 1057 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Mandir Bazar P.S case no. 19 of 2026 dated 20/01/2026 under sections 126(2)/117(2)/118(1)/74/76/109/115(2)/351(3)/3(5) of the BNS.
In the matter of: Dipankar Roy
...Petitioner.
Ms. Reshmi Khatun Mr. Minhaz Serwam Islam ...for the petitioner.
Ms. Manisha Sharma Ms. Suchismita Dutta ...for the State.
1. Learned counsel appearing on behalf of the petitioner submits that the FIR is a result of a scuffle between the neighbours.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. She relies on the statement of the victim and other local witnesses as well as the injury report. The injury report shows infliction of a sharp cut injury on a vital part of the body like the scalp.
3. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.
4. Accordingly, the application for anticipatory bail is rejected.
