Affidavit of service filed on behalf of the petitioners is taken on record.

By the present writ petition, the petitioners seek for their appointment to the post of Anganwari Sahayika workers and Anganwari helper under respondent no.5 at Hanskhali Block Gram Panchayat.

This is a second round of litigation.

The earlier two writ petitions filed by the petitioners being WPA 30447 of 2016 and WPA 30547 of 2016 were disposed of by separate orders dated 4th January, 2023 with the following similar direction :

"

The writ petition is disposed of with a direction upon the respondent no.4 to treat the same as a representation and pass a reasoned order. The petitioners shall be communicated the order.

The only issue to be decided would be whether the petitioners were successful at the interview for the post of Anganwadi Sahayika at the Hanskhali Block and whether

their names had appeared in the panel as selected candidates.

If the questions are answered in the affirmative, in that event, the reasons as to why the petitioners were not granted the appointment shall also be stated." 5.

Pursuant thereto orders have been passed by the Child Development Project Officer, Hanskhali ICDS Project, Nadia on 19th April, 2023. As per the aforesaid orders, the marks obtained by the petitioners are enumerated as follows :

i) Smt. Kabita Biswas - 36.6 marks ii) Smt. Biva Rani Biswas - 32 marks iii) Smt. Bharati Das - 13.25 marks iv) Smt. Anjali Biswas - 15.75 marks v) Smt. Tandra Biswas - 17.75 marks vi) Smt. Ramoni Roy - 10 marks vii) Smt. Bijali Adhikari Roy - 24 marks viii) Smt. Rinku Biswas - 13.25 marks 6.

The Child Development Project Officer after considering the aforesaid marks, has observed that marks obtained by the petitioners are less than the marks obtained by the last empanelled candidate of the similar category and accordingly, the petitioners were held to be unsuccessful candidates.

As per the orders passed in the earlier writ petitions, the questions whether the writ petitioners were successful at the interview for the post of Anganwari Karmee and Anganwari Sahayika and whether their names had appeared in the panel as selected candidates are in the

affirmative, in that event, the reasons as to why the petitioners were not granted the appointment shall also be stated.

Since it has been found by the authority concerned that the petitioners are unsuccessful candidates, hence, the instant writ petition seeking for appointment falls short of merit. 9.

Accordingly, the writ petition being WPA 8451 of 2024 stands dismissed.

All connected applications, if any, stand dismissed.

Interim order, if any, stands vacated.

12.

There shall be no order as to costs.

13.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
