Public Prosecutor Mr. Bibaswan Bhattacharya ... ... for the State Petitioner renews his prayer for bail. It is submitted on behalf of the petitioner that no narcotics was recovered from his possession. Learned Advocate for the State opposes the prayer for bail. We have considered the materials on record. 61.5 gms. of Yaba tablets were recovered from the residence of the petitioner. The aforesaid incriminating materials support the charge of conspiracy with co-accused in dealing in 5000 pieces of Yaba tablets. Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. The application for bail is thus rejected.
