1. Although this appeal is not maintainable before a Division Bench, however, with regard to a fair stand taken by Mr. Paritosh Sinha, learned Senior Counsel appearing on behalf of the respondent that an application has already been filed for withdrawal of the application in which the impugned order was passed, we dispose of the appeal on the basis of the statement made on behalf of the respondent.

This order shall not prevent the respondent to apply afresh before the learned Arbitral Tribunal upon prior notice to the appellant.

Under such circumstances, the appeal is disposed of with the above observation.
