1. The petitioner, a political functionary, on going through certain media reports has rushed to the court and filed this public interest litigation alleging that the private respondent has put up illegal construction as there is every likelihood that the building will collapse. As could be seen from paragraph 6 of the writ petition that the only source of information appears to be media reports.

2. Learned advocate appearing for the municipality submitted that after media reports the structural stability of the building was assessed by inviting the engineers from the Kolkata Municipal Corporation along with the engineer of the respondent municipality

and it was found that the building is structurally stable.

Apart from that, the learned advocate submitted that the building has been constructed in accordance with sanctioned plan and the learned advocate for the developer submitted that all records are available with them.

3. Considering the facts that the petitioner is not a commoner but a person with political background who ought to have been more vigilant and careful before filing this writ petition. The petitioner would point out that the representation given to the Deputy Secretary, Government of West Bengal, Department of Urban Development and Municipal Affairs was forwarded to the Chairman, Serampore Municipality vide Memo dated 25th March, 2025, with direction to enquire into the matter and take necessary action and sought for conclusive action taken report to this end.

Therefore, we dispose of the writ petition by directing the Chairman, Serampore Municipality to respond to the Deputy Secretary, Government of West Bengal, Department of Urban Development and Municipal Affairs and submit an action taken report after which the Deputy Secretary, Government of West Bengal, Department of Urban Development and Municipal Affairs shall send an appropriate reply to the petitioner's representation.

The Chairman shall comply with the direction within a period of three weeks from receipt of sever copy of this order and after

receiving the action taken report the concerned Deputy Secretary will inform the petitioner in writing within two weeks thereafter.

5. With the aforesaid direction the writ petition is disposed of.
