Heard learned counsels for the parties.

The petitioner is in custody for about 250 days and prays for bail.

Learned counsel for the petitioner submits that the petitioner is not the principal accused and has only been used for the purpose of utilizing his bank account where some money was deposited.

Opposing the prayer, learned counsel for the State submits that the petitioner started a proprietorship firm in the name of Mondal Enterprises wherein Rs.20 lakhs was diverted. Subsequently, another sum of Rs.7 lakhs was diverted to his account from the account of the co accused. The petitioner is the beneficiary of the entire transaction.

Charges have been framed and dates fixed for examination of the witnesses.

I have considered the material on record. The material on record prima facie suggests direct involvement of the petitioner in the alleged offence which strikes at the economic security of the society at large.

Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
