Mr. Subhojit Saha ...for the petitioner Dr. Madhusudan Saha Ray ...for the WBSEDCL It is fairly submitted on behalf of the petitioner that in view of the nature of the disputes raised in this petition and in particular the fact that the disputes raised in this petition pertain to the impugned two bills, for the period 10.04.2022 to 22.07.2022 and 04.07.2023 to 16.10.2023, respectively, the matter is referred to the concerned RGRO, having jurisdiction.
The fair proposal on behalf of the petitioner is not opposed by the WBSEDCL. In view of the above, WPA 7993 of 2026 stands disposed of by granting a liberty to the petitioner to file an application before the RGRO for resolving all their disputes in respect of the above two bills. If any such application is filed, the concerned RGRO is directed to dispose of the same within a month from the date of receipt thereof, in accordance with law.
It is made clear that there has been no adjudication on the merits of the case and all issues are left open for the concerned RGRO to decide, in accordance with law.
In view of the fact that pursuant to earlier interim order of Court and the fact the petitioner has paid the disputed amount of Rs. 6,15,000/-, the WBSEDCL is directed to restore the electricity connection to the premises of the petitioner. It is made clear that the above connection is re-connected subject to timely payment of all current bills raised. In default of any one bill, immediate disconnection should be resorted to of the electricity connection. Liberty is granted to the WBSEDCL to take appropriate steps, in accordance with law, in case there is any unauthorized pilferage or tampering of the electricity connection granted to the petitioner. Affidavit-in-Reply filed on behalf of the petitioner be kept on records.
