The present writ petition has been filed alleging non-payment of the petitioner's dues despite the successful execution of a work order issued by the Executive Officer, Raipur Panchayat Samity, Bankura.

It is not in dispute that, during the pendency of the writ petition, the petitioner has been paid the entire value of the work order amounting to Rs. 4,76,160/-.

Learned counsel appearing for the petitioner now confines the relief sought to a claim for interest on account of delayed payment. Learned counsel for the State submits that the delay was occasioned by the non-availability of requisite funds at the material point of time.

In my view, there is no statutory provision placed before this Court mandating the grant of interest in the present case. Moreover, the question of entitlement to interest would involve adjudication of disputed factual aspects, which cannot appropriately be undertaken in writ jurisdiction.

In the aforesaid circumstances, this Court is not inclined to grant any interest in the present writ petition. The petitioner shall, however, be at liberty to institute a civil suit claiming interest, if so advised.
