It is submitted by the Advocate appearing on behalf of the West Bengal State Electricity Distribution Company Ltd. (in short, "WBSEDCL") that pursuant to an earlier direction of Court, he has obtained instructions as to whether the petitioner had been given a right of hearing or not.

It is also submitted by the Advocate appearing on behalf of the WBSEDCL that the petitioner was given a right of hearing and was duly heard by the Appropriate Authority before passing of the final assessment dated February 27, 2019 which is assailed in this petition. In view of the aforesaid and the fact that the petitioner has an alternative statutory remedy in law, I am of the view that the instant writ petition is not maintainable.

WPA No. 8775 of 2021 stands dismissed.

There shall be, however, no order as to costs. Liberty is granted to the petitioner to approach the Appropriate Authority, if so advised, in accordance with law.
